My Journey With Bird Songs

For the past 11 years, I have been working on incorporating bird songs into my music. When I say “my music”, I am talking about my improvisations, because all of the music I compose starts with improvisation, which I then sculpt into compositions. To me, this is a more “natural“ way to go, but then again, that’s been my approach my entire life. When the composition is set, I leave space for improvisations based on the bird songs, as well as motifs created from the surrounding soundscape. Six of my bird song compositions that are currently in my repertoire were originally created back in 2008 during a 5-week residency at The MacDowell Colony in Peterborough, New Hampshire.

I was completely seduced by the bird songs around my studio and decided to play around with them for just one afternoon.

The proposal I submitted for that residency had been to create a series of compositions for an improvisational duo with bassist Mark Dresser, for a recording session scheduled for late July. I also planned to work on a side project, which was a large work for my big band based on Pythagoras’s and Johannes Kepler’s “Music of the Spheres” concept. I brought two suitcases full of books for research to the colony. But when I opened one of my suitcases, a book I had recently bought, David Rothenberg’s Why Birds Sing, fell out of the suitcase. I didn’t remember packing that book! I also brought a book of Amy Beach’s piano music. That I did remember packing because she was an integral part of the success of the MacDowell Colony. I also had a small manuscript book in that suitcase, and for another unknown reason, out fell the letter I had received 11 years earlier, from Adrienne Fried Block, who at that time was writing Amy Beach, Passionate Victorian: The Life and Work of an American Composer, 1867-1944. You would think I would have paid attention to all of these signs from the universe, but no, I initially decided to stay the course with the Spheres side project. That only lasted a day. I was completely seduced by the bird songs around my studio and decided to play around with them for just one afternoon, then get back to work. One afternoon turned into the entire residency; I just had to play with those birds! When would I ever get another chance like this, to have a piano in the middle of the woods, and to play freely? Instead of reading about Kepler, I read David Rothenberg’s book every day, and went to the local bookstore to find Donald Kroodsma’s book with recorded bird songs, The Backyard Birdsong Guide and an illustrated copy of The Music of Wild Birds adapted from The Field Book of Wild Birds and Their Music by F. Schuyler Matthews, who wrote that book in 1904, in Campton, New Hampshire, less than 2 hours from the MacDowell Colony.

My designated studio was Delta Omicron, and inside was a beautiful Mason and Hamlin grand piano. I had a digital recorder and was able to put the microphone in a small window, covering it with a curtain to have a little separation from the piano, which enabled me to hear the birds clearly through my headphones. In this way I was able to adjust the volume I played on the piano so that the birds and I were balanced. I never saw them, so I was never sure who was singing what.

Every day for five weeks, I improvised with songbirds and any other creatures that made their voices heard, and recorded each session. My goal was to become a member of their band, so to speak. I listened deeply to their singing, and carefully infiltrated their ensemble. They, in turn, sang to me and with me and seemed to be okay that I was not only privy to their conversations, but would take part in them as well. We had a standing jam session time at around 10 a.m. each morning until lunch. Then they would retreat, and I would do some reading and listen to our recordings. They would come back out to sing with me around 4 p.m. until I left them for a swim in the local pond. There was also the after-dinner bird ensemble, and we would make music together, but not for long, as they had other business to attend to. In the evenings, I would listen to our recordings of the day, and make notes on the improvisations that would become compositions that I could play again and also perform with other musicians. 
As I listened, I made marks in the editing track and would decide on what to keep, sometimes switching sections around, but for the most part only editing what I considered “meandering” type improvisations as opposed to fully formed compositions through improvisation.

The first bird I began improvising with was the American Robin. In fact, the most well known song, Cheerily, Cheerily, seemed to creep into all of my improvisations. I slowed down the song just a bit, and lengthened the motif, and played around with it in garage band.

Over time, my improvisations on this theme became a singular line composition, much like the style of early Ornette Coleman, that I freely improvised. I gave it the title “If You Call Me, Then I’ll Call You” and dedicated it to Mark Dresser. The title rhythmically matches the first two measures, and it also represents what the robins use their songs for, calling each other, and what Mark and I have been doing for over forty years, calling each other.

Just before sunrise, the first bird I heard singing was the Hermit Thrush. The landscapers at MacDowell referred to the hermit thrush as a deep woods singer, and told me it was the first one singing at the break of day, and first one back into the woods just before sunset. Commonly known as the Nightingale of the Americas, this bird has an amazing set of songs and calls. It’s no wonder that Amy Beach composed two piano pieces based on these songs, one for the morning and one for the evening. She also had perfect pitch and could sit in the woods for hours transcribing bird songs. I have been playing her composition A Hermit Thrush at Eve for years, adding improvisation over her harmonic progression and using hermit thrush songs as a point of departure for improvisation. I have added my version below. Before you listen to the recording, check out the songs of the hermit thrush, and you’ll understand the brilliance of Amy Beach.

After hearing the hermit thrush and the american robin, the next two birds I would hear in the morning were the Black-Capped Chickadee, and the Chipping Sparrow. The Black-Capped Chickadee has a two note song and several calls, but it was the two note song that I was responding to, and the bird responded back with the same two notes. The chipping sparrow has two songs and several calls. The songs are long dry trills, one being faster than the other. I was hearing the faster one and he alternated his song with the black-capped chickadee. I began imitating both of them, improvising in between their songs and my imitations.

As I continued improvising, I integrated both of their songs into a bass line, and then began developing a melody with the two note song from the black-capped chickadee.

All of these improvisations went on for many hours, and other birds would join us for a moment or two.

Originally I had titled the improvisations “Me and the Chickadees”, but I changed it to “Hello” after reading about how bird songs have been set to mnemonics, using a syllabic rhythmic phrase. I decided that the two note song of the black-capped chickadee, a bird song I heard every morning, should quite obviously be called “Hello”.

The bird I had the most fun with was the chipping sparrow. His dry trill and constant singing at regular intervals of time provided tempo and an ostinato for my improvisations. I used the age old technique of a repetitive note as an imitation of the chipping sparrows dry trill, and that became a “thread” for the composition, tying it together. Everything else evolved through improvisation. Think Chopin’s Raindrop Prelude, or any number of compositions. “One Note Samba” by Antonio Carlos Jobim is another good example. As you listen to the recording below, you’ll hear the chipping sparrow, and a dark-eyed junco in the background who wanted to join in with us.

After editing the recordings, I began the tedious process of transcribing. For some pieces I transcribed note for note exactly what I had played. For others, I kept melodies, harmonies, bass lines, and motifs, using them as a jumping-off point for improvisation. I was able to transcribe two of my bird song compositions “Hello” and “If You’ll Call Me, Then I’ll Call You” before I left the MacDowell Colony. We recorded them on my return to New Jersey,  during that aforementioned recording session with bassist Mark Dresser and a few days later we performed them live in New York City at The Stone. (Our recording, Duetto, was released in 2012.)

I was staying true to what the birds and I had created.

One of the benefits of being a performer-composer are the ensembles that I lead, and other people’s ensembles that I perform with, where I can arrange the music I compose for any combination of instruments. Throughout these performances, I constantly referred back to my original recordings, making sure I was staying true to what the birds and I had created, and especially to the surrounding soundscape which was the palette for the compositions. I also created more space in the notated score for improvisation, but with the caveat that the improvisations needed to reflect the bird songs and the motifs. Thankfully, the musicians I performed with had a wide range of musical experiences and could untether themselves from the standard go-to licks, as we say in the jazz world.

I took a different approach for my next bird song composition, Birdsongs for Eric, a 20-minute suite for septet, based on the flute improvisations of the iconic jazz musician and composer, Eric Dolphy, commissioned for the “Eric Dolphy: Freedom of Sound Celebration Series”.

I discovered that in virtually every solo Dolphy took there were bird songs.

In 1962, Eric Dolphy told Downbeat magazine interviewer Don DeMichael, “At home [in California] I used to play, and the birds always used to whistle with me. I would stop what I was working on and play with the birds.” I can totally relate to that quote! Happens to me all of the time. 
The quote and Dolphy’s music inspired me to try a different type of process. With the help of the Cornell Lab of Ornithology’s eBird site and their online Macaulay Library, I was able to study the birds in the area of Los Angeles where Dolphy grew up. I compared those bird songs with as many recordings of Dolphy that I could find and discovered that in virtually every solo he took, not to mention melodies he wrote, there were bird songs or motifs that clearly represented bird songs. I improvised with those bird songs for a bit, then chose the songs I wanted to incorporate into the composition and gave instructions to the musicians to base their improvisations on those motifs.

After all of this experimenting, I formed what I now call the Birdsong Trio, piano, bass and flute. We worked on the music for several years, performing here and there, and in 2016 I decided it was time to do a recording. I commissioned a graduate student that I was mentoring at the Vermont College of Fine Arts, Kyle Pederson, a very talented composer, to compose a piece for this new recording. Kyle, who is from Minnesota, chose the song and calls of his state bird, the common loon, and titled his piece “The (Un)Common Loon”.

The result of these efforts was the release of Diane Moser: Birdsongs (Planet Arts Records), and little did I know the resounding effect this would have on critics, music fans, and students. We have had truly wonderful reviews from jazz, contemporary fusion, classical and rock music publications, and even a heavy metal blog! Evidence of the universality of not only music, but of bird song.

What has intrigued me about the reviews, is that not only are the reviewers understanding the music, but they are also talking about their own memories of listening to birds, the joyfulness of the music, and how it makes them feel relaxed. When we play our concerts, I begin with a short Deep Listening session with the audience, settling in, closing their eyes, thinking about their favorite birds, thinking about their favorite bird songs, and then I invite them to vocalize their favorite bird songs. I also tell them that they can continue the vocalization for as long as they want. As the audience is vocalizing, our trio improvises with them, and at some point we segue into Birdsongs for Eric.  At the end of our concerts audience members have told me they felt transformed, that they were listening differently, that they heard the music in a way they never heard before, and that they felt completely at peace. They often tell me about their bird hikes, show me photos, discuss articles they have recently read and so forth.
 To this day, I receive emails, postcards, photos, text messages, Facebook posts, and messages from my audience base about their experiences with birds and walking in the woods.

Recently I received a Faculty Research Grant from The New School for my new project called “Waterbirds: Environmental Dialogues Through Music”, which will include the creation of a 50-minute music composition for my Birdsong Trio, incorporating field recordings that focus on coastal and wetlands birds and their disappearing habitats in and around New Jersey and New York. This is a different approach for me towards creating music, but I am thoroughly enjoying it! Thus far, this project has me traveling the coast of New Jersey, making field recordings and going on bird hikes with the Bergen County Audubon Society, the Cape May Bird Observatory, and New Jersey Audubon. I was granted a research permit from the United States Department of the Interior to work with the National Park Service, and the U.S. Fish and Wildlife Service at Sandy Hook Gateway National Recreation Area in Highlands, N.J., where I spend lots of time. I’m amazed by the work that the Audubon groups, NPS, and US Fish and Wildlife Service are achieving on environmental clean-up, bird and bat habitats, education, land management, and so much more. I love the field-recording process and have already worked on one soundscape composition with my Birdsong Trio, which also includes a film. In part two of this series, I’ll share the film and other journeys I have made with bird songs.

The Curious Case of Keiko Yamada

The evening of August 31 began like most Saturday nights at the start of the fall semester. I was reviewing course plans and readings for the upcoming week, while I casually scrolled through my email. It was late, and I had long since lost whatever drive had propelled me earlier when I received an email from David Biedenbender, a friend and colleague at Blue Dot Collective, with the subject line “Larry Clark.” Curious, I clicked on the message and was presented with a top-line that read, “This is SO NOT OKAY…” above two screenshots. The first was an image from jwpepper.com of a Grade 1/2 string orchestra piece entitled Kon’nichiwa by a composer named Keiko Yamada with the description: “This piece is ‘hello,’ with a smile on your face.”

I was confused. The title and description were, at worst, innocuous, maybe trite, but they certainly didn’t warrant an all caps critique. It wasn’t until I scrolled down further to the second screenshot that I began to understand. There I found a copied message from Owen Davis, a composer/percussionist/music teacher from Flagstaff, AZ that outlined the controversy signaled in the email’s subject line. It read in part[1]:

*PSA* to all of my friends in music education and specifically the band world: Prominent composer/Arranger Larry Clark made a pen name “Keiko Yamada” to pretend to be a Japanese Female composer in order to profit from calls for diversity in music education! […] To make things worse, after being pulled from some prominent music publishers after being publicly outed for this, some publishers decided to put his real name on the score. This winter [he] is an invited presenter at the prestigious Midwest Band Clinic leading a talk on “Selecting Quality Literature” for band.

Despite the anger expressed in Davis’s account and his speculated motives, my initial reaction was disbelief. The idea that a white male composer decided to use a pseudonym that did not conform to his race or gender read almost like a bad joke—who could possibly think this was a good idea? Moreover, I thought, who needs a pen name in twenty-first-century American music publishing? Women and people of color aren’t overtly banned from publishing or self-publishing their music, and white men are especially not prevented from getting their works performed. There’s no reason to have a pen name today. And while cultural appropriation has become a topic of discussion recently, there are no prohibitions that would necessitate a fake Asian identity to write a piece like Kon’nichiwa. White male composers have been doing it for centuries and continue to do so.[2]

I logged onto Facebook to see if the story had developed. It had, but like most social media discussion, it was more emotionally enlightening than factually informative. Comments were flooding in, some expressing confusion, but mostly anger. While monitoring the conversations, I decided to verify the charges against Clark as best I could. I checked the Midwest Band Clinic schedule, and Clark’s clinic “In the Eyes of the Beholder: Selecting Quality Literature” was indeed happening. Then I went to the JW Pepper site. I saw more Japanese-themed titles and pieces with duel compositional credit given to Larry Clark and Keiko Yamada.[3]

At this moment, my disbelief became resentment. The thought that Clark, a former Vice President and Editor-in-Chief at Carl Fischer Music, one of most prominent publishing companies for educational music in the country, had used his position to publish and promote works under his Keiko Yamada pseudonym was enraging. Because it was late and no additional information was forthcoming, I grew irritable. I told my friends and colleagues I would certainly be there at Clark’s Midwest presentation to ask him what it meant to program “quality” literature. Like many commentators, I fantasized about a confrontation, the chance to be seen and be heard. But this online back-and-forth quickly exhausted its potential, and failed to provide any release. We needed and deserved to know more.

The next day, Clark issued a statement of apology on his Facebook page.

To my friends and colleagues in the music community, I offer my heartfelt apology. Several years ago, I wrote music using the pen name Keiko Yamada. I sincerely meant no harm in doing so. It has been common for composers and authors to use pen names for centuries. Times have obviously changed, and I realized that the use of this pen name was uninformed, insensitive, and out of touch with the need for cultural appropriation and diversity in music.

In 2016, together with my publisher at the time, we decided to eliminate the use of pen names altogether. I chose to have all of these pieces changed to reflect my name as a composer. Old inventory was removed and recalled from music retailers. New versions with my name as the composer were reprinted, at my personal expense.

I accept the responsibility for my uninformed decision to use this pen name. I believe in the music as I do all of the music I write, but what I did was wrong and needs to be corrected.

I can’t change the past and am trying to make things right through my own company Excelcia Music Publishing. Cultural authenticity is paramount, and I will strive to put the composer first by seeking out composers of diverse backgrounds that better reflect the students that will perform the music. I hope that my actions going forward will demonstrate my desire to learn from my mistake.

I am sincerely sorry and will continue to be better informed and sensitive to these important issues.

When I read this, I felt deflated. What should have provided the information crucial to making sense of the emotions riled up the night before was missing. Clark’s apology failed to explain why he decided to use a pseudonym. Its absence only aggravated my frustrations. I took to social media and again found comfort in peers who felt similarly disappointed in Clark’s statement. Unfortunately, by this time, the Internet had produced its inevitable backlash. And we were confronted by Clark’s defenders who posted hurtful remarks like “I’m sorry this was a problem for you ppl [sic] are so triggered and emotional these days I don’t think you need to apologise [sic]” and “Seriously? I see no need to apologize. This world is getting way too sensitive!” Needless to say, but this didn’t help.

As the debates around Clark grew increasingly acrimonious, a series of dramatic actions took place. The Midwest Clinic canceled the Clark presentation. Music by Keiko Yamada was quickly removed from Internet shelves. Webpages disappeared. Carl Fischer issued a statement to their orchestra directors about the controversy saying, “We now realize we should have gone further by taking these publications out of circulation, an action we have since taken.” Clark reiterated his apology online. Everything regarding Larry Clark and Keiko Yamada was shut down in a mere matter of days.

The disappearing of Clark and Yamada felt vaguely like a cover-up, a way to cut debate off before more significant questions could be asked.

The responses to these actions were mixed. Some friends and colleagues were jubilant. For them, the offender had been punished, and the offending material erased. But their numbers were small, and their satisfaction generally waned in the wake of the Midwest Clinic talk cancellation, and the removal of Clark’s music from available outlets. Others, myself included, were more ambivalent. The disappearing of Clark and Yamada didn’t feel like a resolution. It felt vaguely like a cover-up, a way to cut debate off before more significant questions could be asked. Like questions that extend beyond Clark about his enablers at Carl Fisher, about the people who knew about Keiko Yamada and remained silent, and about the other potential pen names that did or may even still exist in company catalogs.

Most of all, the actions still didn’t answer the question of why Larry Clark had done what he had done. What was Clark’s rationale? What possible circumstances allowed him to think Keiko Yamada was a good idea? My initial research only produced more questions, like if Keiko Yamada’s name was used specifically for originally composed Asian-styled pedagogical orchestral music, why did Clark/Yamada arrange Albert Ellmenreich’s Spinning Song? I realized I needed to talk to Clark. Fortunately, Clark was also eager to talk, and a month after the scandal broke,[4] we were able to sit for an interview.

What follows is a transcript of our conversation I produced in the hours following our meeting. (Clark did not want a recording and has approved the text below.) Our time was limited, which prevented some follow up questions that I wanted to ask. Overall, the exchange was frank, and I appreciated his readiness to respond to all queries that I posed.

Jennifer Jolley: In your initial apology you claimed that using a pen name “has been common for composers and authors…for centuries,” but that “[t]imes obviously have changed.” Looking over the pieces under the name Yamada it seems that you adopted this name in 2009, am I correct?

Larry Clark: I wrote the first piece (Hotaka Sunset) in 2004 and it was published in 2005.

JJ: Okay, you created this persona in 2004. So, then you believed it was appropriate to create the persona of an Asian woman in 2004. I guess my question is: what events or developments in the past decade caused you to reassess the decision you made in 2004?

LC: I wasn’t thinking that it was a good idea in 2004; it was flawed thinking on my part anyway. I didn’t give it a whole lot of thought. When I started writing in the publishing business, I was mentored by a lot by older composers in publishing. It was really common that most of them had pseudonyms. This is not an excuse, just how it was when I started getting pieces published.

JJ: How many of these composers had pseudonyms? How many did they have?

LC: I can’t really even tell you that because I don’t know. All of the composers that I had worked with at least had one. Sometimes it had to do with market proliferation; sometimes it had to do with that you’re known as a person who writes at a certain grade level, and sometimes to be taken seriously at a different grade level you needed to use a different name.

I don’t have any excuse for doing this at all. I didn’t give it a lot of thought. I realize it was super insensitive, not a really well-thought out idea. I wish I could take it back, honestly. Going forward, I realize there was no excuse. I was being ignorant and it’s appropriation. Back in 2005, no one really thought about it like they do now. Again, not an excuse.

JJ: So now I’m curious as to when you decided not to use the Yamada pseudonym anymore. What prompted you to do this? You wrote that you and your publisher worked to eliminate pen names and sought to recall inventory that didn’t list you as the composer. Why didn’t you or Carl Fisher Music make a public statement on this? The recalling of music at your own expense suggests that you thought it was at least problematic, why did you remain silent?

LC: It started to feel like it was a bad idea when things started to change culturally, and with more awareness, and political correctness. I’m super apologetic to you; I understand how this could be interpreted.

My feelings about using the pen name started to change when the pieces began to have success. People wanted to meet Keiko Yamada and possibly commission works. Honestly, I didn’t know what to do. I felt really uncomfortable about that. At first, I was not trying to keep it a secret. Musicians in the recording session were aware it was my pen name. When we started receiving requests for information I tried to be more elusive about it, which I regret greatly. I guess I just got scared, which is not a good excuse, but the truth. As the political climate changed and the country became more divided, that is when the topic came up at Carl Fischer. And that is when I began to think about the opportunities this could be taking away from real composers of diversity, and how hurtful that could be.

We got into discussions at Carl Fischer about this, so we decided to stop. At first, we thought it would be best to get rid of all the music. That did not sit well with me, because I believed in the music. I thought it was some of my best work, and wanted it to continue, so I made the choice personally to take whatever ramifications came my way and have the pieces changed to my name. The problem is, we didn’t do a good job expressing all of that to the public, because we feared what the ramifications would be. We had concern that what has been happening would happen. I was willing to at that time take it; I wanted to have the music continued. The problem was with the execution of what was done. I was on the team; it was a company decision and that’s how it was handled. [Ed. Note: Sonya Kim has been president of Carl Fischer since 2008.] I think we would all agree that we didn’t handle it well and we didn’t handle it thoroughly and I regret that too.

In retrospect, I, together with Carl Fischer, could have been more transparent and thorough in handling the situation.

JJ: So the orchestra people/directors knew about the pseudonym?

LC: Many of the orchestra people were very upset when that happened.

JJ: Why?

LC: Because of the same reason as the band people. On Facebook there is a String Orchestra Directors Page and that information blew up then. It was split: they took sides. At the time, I asked Sonya Kim, president of Carl Fischer what are we were going to do.

JJ: I want to pinpoint something you said earlier. When exactly did Keiko’s music become successful? Can you pinpoint a year or piece?

LC: People wanted to meet me/her in either 2006 or 2007? Yes, it is Japanese Lullaby that became successful. It was selected for a lot of festival lists and was performed at Midwest, etc.

JJ: Following up on this, Keiko Yamada is a composer listed on a few Prescribed Music Lists, and I believe one of Yamada’s works was performed at the Midwest Clinic. Did you alert anyone involved that you were the composer of the works selected? Do you remember which state lists Keiko Yamada was on?

LC: Which state lists…this is very challenging to determine…

JJ: That is what I’ve been discovering.

LC: I know they were on Florida, Texas, maybe Maryland? There are a lot of states that don’t have a state list. Many of the pieces were performed at Midwest. This happened multiple times, and almost every year.

This is how we tried to alert people in 2016. The intention was not successfully executed. Carl Fischer was to alert the dealers that the names were changing to mine. The Letter asked music dealers to alert the music committees for state lists. This was sent out after these pieces were selected. JJ: While the use of a pen name does date back centuries, this doesn’t satisfactorily explain your motive for using one. A pen name is a strategy employed in response to exigent circumstances such as the protection of an individual’s physical safety (dissents in unfree societies), the preemption of discrimination (Jewish actors that Anglicize their stage names), or to allow individuals access (women authors seeking the consideration of male dominated publishing houses). Given that you were a successful American composer working in a publishing house what were the circumstances that necessitated and/or motivated your creation of Keiko Yamada?

LC: Well, it was not well thought out, I had written a piece that was Japanese in style; I was having difficulty with sales in orchestra music, because I was considered more of a band composer. When they see my name they think, “Oh well, he’s a band music guy. He’s just writing band music and then writing and arranging it for strings.” I was not taken as seriously at that point as an orchestra composer.

JJ: So to clarify, this piece you’re talking about was initially a string piece, not a band piece that was later transcribed to strings?

LC: This was initially a string piece. Clarification: there are no Keiko Yamada band pieces.

JJ: I find it fascinating that publishing educational band and orchestral music was so segregated and isolated. That just boggles my mind.

JJ: That’s nuts because you have band pieces for higher levels.

LC: I think it’s easier to go top-down; I started writing music for lower levels first, so it’s harder to go up. There was a time at Carl Fischer where they wanted to label music as “serious vs. educational music.” I was against that.

JJ: That’s so wrong. Anyway, how did you invent the name Keiko Yamada?

LC: The name was not well thought out, not sensitive, not all those things. I thought, Yamada is a common Japanese surname. Keiko…I don’t remember. I didn’t want anything gender specific. I didn’t do enough research.

JJ: I have to say, I’m not of Japanese descent, but I’ve known a few Japanese people in my life, and “Keiko” is very much a feminine name.

LC: I realize that now; I didn’t do a lot of research. Honestly, I don’t really have a good answer for you, because it was not well thought out.

JJ: Next question. Colleagues of mine have noted that when they researched Keiko Yamada, they were confused by her online biography. Several publishers and even a young student presenting on Yamada used the birth date of another musician of the same name—it’s the first Keiko Yamada musician when you Google the name. You also contributed to this effect by having most of Yamada’s work be Asian themed (Kazoku, Kabosu, Yuki Matsuri, Rickshaw, Japanese Hoedown etc.), and then when you had Keiko Yamada arrange Albert Ellmenreich’s Spinning Song. So I guess my question is if Yamada is an innocuous pen name, why did you develop such a distinct body of work for her? Was it because these pieces are strictly orchestral in nature?

LC: With regard to the birthdate and the bio, I have no idea where any of that came from. There was never a bio or birthdate sent out. Regarding a body of work, yes, the interesting thing is that—no excuses—I found a different voice to write in, which I enjoyed. I was trying not to be disrespectful or cliché to the music to Japan, I creatively sounded like a different composer I thought. Again, it doesn’t change the fact that we’re here.

Spinning Song…That was the only one that was not of Japanese influence…I don’t remember why. I don’t know.

JJ: Is it because Spinning Song fell under the purview of “orchestra music” and Keiko was strictly an “orchestra composer”?

LC: I wasn’t doing as much orchestra music under my own name because it wasn’t doing as well.

JJ: Following up on this, do you have records of how many other composers in 2016 in the Carl Fisher Music catalog were writing under their own name and an additional pen name? If so, did any of those composers use a pen name that didn’t conform to their gender or race?

LC: Actually, not with Carl Fischer. My first job in publishing was with Warner Bros. Publications in Miami in 1995. [Pen names were] used often for grade level and used often for a lot of arrangements. If someone did use pen names, it would be for Grade 2 marching band arrangements, for example if they were known more for say more difficult arrangements.

JJ: Does this still go on?

LC: I think so. I was working at Warner Bros. until 1999. I still believe some are still out there.

Actually, I have a funny story about this. I started out as a marching band arranger, and a friend of my boss Jack Bullock, who was a middle school band director, said, “I like this guy Larry Clark’s arrangements; is that a pseudonym for you?”

JJ: That’s wild.

LC: My name is so simple, it probably sounded like a pseudonym to her.

JJ: Did anyone know about some specific pseudonyms? I mean, there seemed to be a reputation that everybody was using them.

LC: There was a reputation of pseudonyms, but no one knew who they were. This was more so in the “pop” arranging scene at WB. We were doing so much so quickly. We had a couple of days or a weekend to turn around these arrangements.

JJ: Did anyone switch their gender or race with these pseudonyms?

LC: Gender or race? YES. Race, but not gender.

JJ: And this had to do with style?

LC: Did this have to do with style? It was similar to what I did, but I took it one step too far. There is one case I remember off the top of my head; it was used to be a specific style of music.

By the way my official title at Warner Bros. was Marching Band and Jazz Ensemble Instrumental Editor from 1995–1999. I worked at Carl Fischer from 1999–2018, and I started my own company in 2018.

JJ: Why did you start your own company?

“I left Carl Fischer on good terms in 2018, and will always be proud of the company and the work I did there.”

LC: I worked remotely (from my Florida home) for Carl Fischer starting in 2003. It is challenging to keep a connection with a company over a long period of time as employees come and go, and so in the last few years I felt more disconnected to the company, despite the ongoing collaboration, conference calls, trips to the headquarters, etc. It was no one’s fault, just happened, and I left Carl Fischer on good terms in 2018, and will always be proud of the company and the work I did there. With my new company I had some ideas on how I wanted to do some things differently.  Self-publishing has become more of the thing. I think it’s because composers don’t feel serviced. We’re trying to help with that.

JJ: So, speaking of Carl Fischer, your position at Carl Fisher Music from 1999–2018 was Vice President and Editor-in-Chief and an archived bio from Midwest describes part of your duties as reviewing thousands of works for publication. Between 2005–2016 did you ever promote Yamada works in your official capacities?

LC: I don’t understand your question. What do you mean by promoting works in official capacities?

JJ: Let me clarify. For example, I believe if you register as a publisher at the Midwest Clinic, you’re allowed to submit some pieces for reading sessions?

LC: The Keiko pieces were already being selected for performances, so there was no need for reading sessions. Midwest has very strict restrictions for what can be programmed on concerts. You have to have one of each grade level from a different publisher on your concert…

JJ: You have to have a march…

LC: You have to have a march, etc. for band. Midwest provides the list of performing ensembles to the publishers once they are selected.

JJ: Did you have a say as to which pieces were on which list?

LC: Yes, but we would send them a CD sampler/MP3 list that also included scores. We would send everything; including Christmas music, because some groups wanted to play those, since the convention is close to Christmas.

JJ: Because that was a good time of year to buy Christmas music, I’m assuming.

LC: Yes.

JJ: Did you ever promote Keiko Yamada’s music over others?

LC: No, we did not promote some pieces over others. We promoted the new pieces in our catalog. We would usually send out separate band and orchestra lists. We would send out CDs for all the new orchestra music and all new band music. If any of these were of interest, we would send you a full score or even a set. We would bend over backwards to get music performed as often as we could. Now it’s all in Dropbox; we have available non-printable scores. We organize it more by grade level.

And again, everything we were sending out was new. We’d send it out in the late spring/early summer for the new school year. Also, Carl Fischer would send out a cover letter on behalf of the composers. I’ve been encouraging composers in my new company to write an additional personalized cover letter in addition if they have time; most composers take me up on that and it has been very successful.

JJ: I’ve spoken with a lot of composers and music colleagues in the run-up to our discussion and there is a lot of frustration, and even anger from their points of view. In their perspectives, your apologies for your actions ignore the real-world consequences of your actions. You were already an established composer; you held a position of power in a prominent publishing company, and yet you decided to compose under the name of an Asian woman. Given the concerted push to diversify music that is occurring when you’re writing as Keiko Yamada, do you understand why many people feel you likely stole opportunities from them?

“All I can do going forward is to try to make a difference for women and composers of color.”

LC: One hundred percent. Of course, I didn’t think about this when I created the name in 2004. Again, this is not something you can take back. All I can do going forward is to try to make a difference for women and composers of color. I’ve already agreed to give every penny I’ve made from these pieces over to help underrepresented composers. I’m still waiting for Carl Fischer to give me a full accounting of how much I made with these pieces. But I also don’t want to do any of this with any fanfare, and I am not looking for any accolades. I know how upset people are, and I know how ridiculously ignorant and insensitive this was.

This is not in line with who I am. I did a very insensitive and uniformed thing; I regret doing this. I understand people may never play my music again. However, I have five boys, and they have to see me handle this the right way. A lot of people said horrible things without knowing me. I have a multicultural family. I adopted two boys from Haiti. I’m disappointed in myself; I’m embarrassed. It’s been tough.

JJ: What do you think you can offer the current conversation about diversity in music given your actions?

LC: Certainly, I’ve been trying to do this throughout my career. There are a lack of women and people of color that are composing. Today it’s even more difficult because there is even more self-publishing. It’s very difficult to find people. It’s a challenge. I’m continuing to do that. We have women and people of color in my company. You know, some people said I didn’t have enough women and people of color, but I just started my company in July of 2018, and it takes time, but I feel I can also help with this. I will have one conversation at a time and work to regain trust.

JJ: Individually?

LC: Yes. There are some people who said I did nothing wrong, but that’s not true. I did do something wrong. I want to talk to those people too. If other composers use pseudonyms, I hope they reconsider using them. I hope I can be a beacon as to what not to do.

JJ: Are there any specific people you want to talk to?

“I hope I can be a beacon as to what not to do.”

LC: Anyone who wants to listen? I would love to hear your feedback. I will be at Midwest, so if anyone wants to talk to me, they can find me.

JJ: How will they find you? Can I tell people how to find you at Midwest?

LC: Excelcia will have a booth, and I will be there, because the most important thing to me is that I don’t want my actions to hurt my fifty composers. They just had their first release. We just started.

JJ: You know, admittedly, I was a little disappointed that your Midwest session got canceled because I thought this would have given you the perfect opportunity to answer the questions we all had personally. Hopefully, by December our deep frustration and anger would be lessened a bit so we can have a constructive conversation with you.

LC: And my topic at Midwest was not to tell people which pieces they should be programming. It was how to pick literature that’s of quality, how to identify pieces with good counterpoint, good harmony and melody, which pieces used good ranges for their specific ensemble, etc.

JJ: And I get what you’re saying here; unfortunately, the word “quality” now is code for “music that has been written by cisgender white males” because “quality” has been used as a knee-jerk response to why it’s still okay to ignore and disregard music written by women and people of color. And then when people like me hear the word “quality” being used in association with programming, I instantly believe those who refuse to diversify programming state that music by others cannot be as good.

LC: I agree that the same people who tried to say I did nothing wrong were also throwing around things like “I only play quality music.” That is wrong, too, and the point of my clinic at Midwest was not to tell anyone what quality music is, but to give conductors tools to look for pieces with good craft. I understand what you are saying about the term “quality” and its implications—I will be more sensitive to that.

JJ: Here’s a question: is your new publishing company more of a distributor than a traditional publisher?

LC: It’s a regular publishing company; it is similarly done like Carl Fisher and others. We do professional recordings and distribution with all the major sheet music dealers of the world. We do a lot more on social media.

JJ: I’m thinking aloud here…is there an “in between” way in which composers who are skeptical about having you publish their works could have some sort of trial period? Admittedly, considering how I identify, I would not want you to publish my music. But let’s say, maybe over quite a few years from now, you can use your publishing company to get a person of color’s music on a Midwest reading session without having them officially sign up with your company?

LC: Midwest has strict rules: they have all these rules on how you have to have certain representation of grade levels, different publishers…it’s challenging. I recently reached out to Kaitlin Bove [the founder of the organization …And We Were Heard] to inquire how I might be able to assist the organization. I think her idea of the recordings is awesome. Here’s the interesting thing. They are finding bands to record Grade 3 and 4 pieces, but they can’t get anyone to record the Grade 1 and 2 pieces, and I said, “I’m your guy!” I’ll record those pieces—even for orchestra.

JJ: That is a great idea. I love this. We composers are so dependent on these recordings, and they’re hard to obtain.

LC: Yes, I’m hopeful that she will be interested in me doing that, and I’d pay for it personally; I won’t have my publishing company pay for those recordings. JJ: Those are all my questions, and I want to thank you for taking the time to chat with me and answer my questions. Is there anything else you would like to add?

LC: I just appreciate the tone and the tenor of this interview. And I want to apologize to you personally, and I’ll personally apologize to anyone, because I know what I did hurt others and I am truly sorry for that. I also have apologized to my kids too, because I want them to see that we are all flawed beings, and we sometimes make poor decisions in life. We have to own up to those mistakes, accept the consequences, try to make amends to the people we hurt, and learn and grow in the process.  I also want them to learn from me so that they think very carefully about everything they do, and how their actions affect others.


As the conversation fades and the transcript becomes my primary reference, things are both clearer and more complex. My first imaginings of confronting Clark the night the story broke bore little resemblance to the encounter. After talking one-on-one, I have to admit, I have more empathy for Larry Clark. I relate to him as a composer and as an imperfect human being. Yet even in retrospect, the experience poses some difficulties for me.

On the other hand, it’s still frustrating and disappointing to read his evasions like “political correctness” or his self-presentation as a victim (“that band guy in the eyes of the orchestra world”). I find myself wanting to yell that white men impersonating Asian women didn’t just become wrong in the twenty-first century. But to be compelled to forcefully say something so obvious is exhausting and worse, it puts the responsibility on me.

And it’s here where I find some clarity to the source of conflict I feel about Clark and Yamada. Powerful people have the luxury of evolving to a point where they might consider the benefits their person and positions have accrued. But this process takes place in real time, time that is experienced very differently by people outside the establishment. How many composers during Keiko Yamada’s “career” lost opportunities because a rental or a place on a state list went to “her”? How many of those selections were motivated by a music director’s desire to diversify their concerts? How many times did a young woman or person of color feel that powerful sense of possibility in imagining someone like them writing the work they were about to play? Moreover, how do we take stock of the reverberations extending from the fact that Clark didn’t confess but rather was caught.

It’s a certain way the open booth at Midwest (which I genuinely recommend) is the perfect encapsulation of the problems and contradictions that I’m feeling: it is laudable but insufficient. The booth will likely be more therapeutic than transformative because it keeps Clark at the center and does little to address the systemic corruption of the larger music world. Indeed, the paradox of the entire Clark/Yamada affair is that Clark does deserve harsh judgment, but focusing too much on him dilutes the ability to see the broader problems. Systems are difficult things to imagine, understand, and transform. Clark’s actions warrant condemnation, but he was aided and abetted throughout Yamada’s fictitious career. A culture of silence and selfishness of vision in the highest reaches of the publishing world permitted Clark to act as he did. For the Clark/Yamada affair to be useful, there needs to be a much more comprehensive and transparent examination of catalogs in the band and orchestra world. If Clark’s claims about the pervasiveness of pen names are correct, we need an account and not just of the composers, but of the administrators and executives who facilitated this.

Composing music is hard, but being a composer is harder. It’s financially precarious, filled with rejection, and driven by a sense of self that is constantly under siege. To be a composer of color or a woman (or both) is beyond difficult. They are profoundly absent in concert halls today, and the situation is not much better when you look at the state lists.[5] The lingering effects of Clark/Yamada are to magnify the paranoia and cynicism too often experienced by underrepresented composers. It confirms the most extreme sense that the music world is an unfair system rigged in favor of the privileged. I guess this is why I can’t offer a succinct summation or tidy lesson learned from this mess. So in place of a conclusion I want to offer thoughts. I hope Larry Clark will continue to work for change. I also hope he knows how much work needs to be done and that there’s a real chance he’ll never balance his ledger. I want him to get to that place, but I also know that I can’t speak for anyone else. Above all, to the women and people of color, I hope you keep writing.

*PSA* to all of my friends in music education and specifically the band world: Prominent composer/Arranger Larry Clark made a pen name “Keiko Yamada” to pretend to be a Japanese Female composer in order to profit from calls for diversity in music education! This is disgusting, misleading, and just awful that we have students being subjected to not even appropriated music, but a fantasy of appropriated music. What does this accomplish? What goals of diversity and growth does this further?

To make things worse, after being pulled from some prominent music publishers after being publicly outed for this, some publishers decided to put his real name on the score. This winter he is an invited presenter at the prestigious Midwest Band Clinic leading a talk on “Selecting Quality Literature” for band. There is so much music that exists in the world of band by diverse voices – why does this still need to be published?

I don’t know what needs to happen and can’t individually leverage against this. I am not a band director, but if I was I probably wouldn’t support his work any longer. As a music educator, however, I am just really frustrated and saddened by this news.

Truly a Wenren—Remembering Chou Wen-chung (1923-2019)

We still don’t want to believe that Professor Chou has passed away. Tears are not enough to express our profound sadness and grief over this tremendous loss. He is a music giant who brought us to and taught us at Columbia University, and mentored us in our creative lives for decades. He has made a huge contribution to the music of our time, yet he is a father-like figure to us. He will be missed by all of us tremendously, and his legacy will live with us forever. Our heavy hearts brought us back to countless memories of his vivid voice and energetic gestures.

Remembering when I studied composition at the Central Conservatory in Beijing in the early 80s, once in a lecture given at the library, to introduce newly imported music recordings, I surprisingly heard a recording of Prof. Chou Wen-chung’s Soliloquy of a Bhiksuni for trumpet and wind ensemble. I just jumped up! Even though it wasn’t in Chinese folk-music style, it struck me as so Chinese! I was deeply impressed by the Chinese spirits hidden behind the striking sonorities. At that time, most Chinese compositions used pentatonic scales in melodic writing while using Western harmony and formal designs, but this piece was not based on pure pentatonic scales. I ran and got the LP recording and I saw his photograph. I realized then that he must have been born in China, and I was very excited by this Chinese-American composer’s music. This is the first time I heard the name — Chou Wen-chung! I discovered that Prof. Chou was involved as a US delegate to China in the late 1970s. He donated many scores, recordings, books, and other materials to Chinese conservatories. After the librarians had catalogued all of these materials, they were made available to students for study from a series of new imported record broadcasting sessions. It was at that point we were introduced to Chou Wen-chung’s music.

I was also lucky enough to have attended his lecture when he visited the Central Conservatory. His public lecture was hosted by the Musicology Department, and attended by many professors and some students in the Musicology and Composition Departments. Besides introducing contemporary American composers and their music, Prof. Chou also answered many questions about music education in American universities. We then learned that he taught at Columbia University in New York City.

It was my privilege to have the opportunity to join my husband Zhou Long to study with Prof. Chou at Columbia in 1986. After graduating with our Bachelor’s degrees in 1983, Zhou Long became the resident composer of the China National Broadcasting Symphony, and I became a graduate student at the Central Conservatory. I needed another three years of study to obtain my Master’s degree, so I came to New York one year later. When I got to know Prof. Chou more closely for the first time in 1986, which was several years after we had attended his lecture at the Central Conservatory and right before I came to the US, it was during the First Contemporary Chinese Composers Festival held in Hong Kong. Prof. Chou took all of our young composers from Mainland China to a delicious Chinese banquet at which we talked about Chinese culture, Chinese music, and its future. This also became a regular event after I arrived at Columbia. Every month, Prof. Chou would host a meeting at the US-China Arts Exchange to discuss Chinese music tradition and heritage, and our responsibility and effort in carrying it on in our culture and society. After each meeting, Prof. Chou took us to a fancy Chinese restaurant on Broadway. We all greatly looked forward to this gathering every month. However, when Zhou Long and I graduated from Columbia in 1993, Prof. Chou and his wife Yi-An treated us to a fancy dinner at a great French restaurant in Greenwich Village. We will never forget the taste and the beautiful mood of that evening. Prof. Chou became our great mentor and we had a close relationship throughout the years since then.

The most important impact of Prof. Chou’s influence on me was not only to use basic composition techniques to write music, but the in-depth study of both Chinese and Western cultures, which would provide inspiration for getting creative concepts and methods for controlling and developing musical elements. The outcome would be unique, in our own language. Prof. Chou inspired me a lot with compositional concepts that unite Eastern and Western styles and techniques. In our early years at Columbia, I also translated many program notes of Prof. Chou’s compositions into Chinese, when his works were being played in Mainland China and Taiwan. I enjoyed doing that because Prof. Chou’s notes are so poetic and beautifully written in English that you have to concentrate hard to find how to say these things correctly in Chinese, in a way that will keep their beautiful literary character and not make them just a frank, straight reciting of facts.

Zhou Long and I also produced a series of programs for Shanghai Dong Fang Radio to introduce 20th-century music. We had one and a half hours in three half-hour segments devoted to the music of Prof. Chou. I compiled all of the materials about his music, wrote the texts for the programs, and discussed his creations in various periods and styles: The first was about the early works of the late ‘40s and ‘50s, like Landscapes (1949) and And the Fallen Petals (1954), which are important orchestral pieces that have been played by many of the major orchestras. Then in the second program came the more abstract style of writing heard in Cursive (1963) and even more so in a very complex score like Yun (1969), which is extremely sophisticated. The third program was devoted to his later works. These three radio programs were widely heard in China and musicians continue to talk about them.

These experiences opened up my view and helped me to break boundaries and find my own voice – as, for example, writing in the style of Chinese musical storytelling, and the reciting tunes in Beijing Opera. I consider this my turning point in terms of new compositional language, concept, and technique. In the technical aspects of composition, Prof. Chou was very precise. He would look at any score carefully first, and he would recommend improvements; then, if I would come back the next week, he would look at it again, then circle a note and say: “Look at that note! You did not fix it. Can you tell me a reason?”

Prof. Chou was very precise. He would look at any score carefully first, and he would recommend improvements; then, if I would come back the next week, he would look at it again, then circle a note and say: “Look at that note! You did not fix it. Can you tell me a reason?”

He also showed us paintings and calligraphy, and he would tell us how he thought of these as counterpoint. He would look at brush strokes on the page and he would see the space between the inner and outer edges of the stroke and the way that it changed as a sort of counterpoint. My pipa solo piece The Points uses an idea like this. In calligraphy, every stroke begins with a point. After you set down the first dot, you turn the brush to make the different strokes that you want; so, the point, the beginning of each stroke, is very important in drawing Chinese calligraphy. Prof. Chou asked me and inspired me to write this piece, which was premiered at the New Music Consort’s season concert devoted to Chinese composers’ music, as part of the NEWworksOCTOBER concert series at Columbia University in 1991, and it won me a reputation because it has been widely performed. In China, it has been the subject of a thesis and it is now a required piece for musicians who study pipa performance at the conservatory as well as in many competitions.

When I was a DMA student at Columbia, Prof. Chou recommended me to become a part of an ISCM film production called Sound and Silence (which was co-produced by Polish National Television and French Adamov Films) and this series introduced my new chamber works to international audiences through European TV networks in 1989. This is a ten-film series dedicated to contemporary music, featuring 20 composers from 19 countries (including 2 from China: I was the one from the Mainland, and the other one was from Hong Kong). Each composer had a half-hour program with his/her music performed, with the composer as one of the performers; there was also an interview by the host, Polish composer Zygmunt Krauze, then the president of ISCM. I played the violin in my own sextet, Near Distance, and sang in my own trio, As in a Dream for soprano, violin and cello. My Woodwind Quintet was also presented in the program. The other half-hour segment along with my program in the hour was Luciano Berio representing Italy. I played two movements in his violin duet collections. Before I left for Poland, Prof. Chou’s wife, Yi-An gave me a lot of clothes – many dresses! “This one could be suitable… That one… Here, try this one…” She took me into her walk-in closet, and looked through all dresses in shelves up to the celling… You could see the dress in the film.

I also sat in on my classmate David Tsang’s private lessons, invited by Prof. Chou. Prof. Chou analyzed his own concerto for cello and orchestra and other works for us, showing us how he designed his pieces with charts. There are different colors assigned to particular aspects or music elements in the structure. One color would represent pitch material, another dynamics, some others would control tension and density, part distribution, timbre, sonority, orchestration, and so on. It was very inspiring to me because I used to write music without a detailed plan covering many aspects. This is a very different and practical method in composition experience. He encouraged us to study Western contemporary music in-depth and gave me his former teaching syllabus in new music analysis, and introduced analysis of music by Varèse, Schoenberg, Webern, Ives, and others. You can’t compose in a unique style until you really learn all cultures well and then can create your own work as a hybrid and speak in your own language.

I studied with Prof. Chou for three years, and one of those years overlapped with my work with Prof. Mario Davidovsky for electronic music composition. When Prof. Chou retired, I worked with Mario for five years until I finished the DMA program, as he supervised my dissertation work. Zhou Long’s dissertation was supervised by Prof. George Edwards, after years of study with Prof. Chou and Prof. Davidovsky. We remained very close to our professors from Columbia University. During the past three decades, Prof. Chou attended almost all concerts with my new works premiered in New York City, including my octet Sparkle and mixed quartet Qi performed by New Music Consort, my China West Suite for two pianos performed by Dennis Russell Davies and Maki Namekawa at the Lincoln Center Summer Festival in 2007, my string quartet At the Kansas City Chinese New Year Concert by the Ying Quartet, and my Si Ji (Four Seasons) performed by the Cleveland Orchestra conducted by Franz Welser-Most at Carnegie Hall in 2005. My Si Ji was dedicated to Professor Chou and was selected as one of the Pulitzer Prize Finalists in 2006. Prof. Chou called me to send his congratulations when he learned the good news.

During the time I studied at Columbia University, I also worked as an administrative assistant at his Center for US-China Arts Exchange for three years, and closely witnessed his hard work, which made a huge contribution to the US-China music education and arts exchange. He was busy teaching at Columbia, but he had to raise money, write many reports for the Center and take care of administrative work. Prof. Chou never used the Center’s facilities or equipment for himself. He was very clear that every cent raised should go directly to the projects that the Center was working on. When I was working there, people would come and ask for a sample of his music. I asked him, “Can I just make one copy here?” but he said, “No. Make a copy outside and give me the receipt.” He never even made a copy of his own music with the Center’s copy machine.

During my work at the Center, we participated in two important composers’ conferences organized by the Center for U.S.-China Arts Exchange and led by Prof. Chou. One was the Conference on Tradition and the Future of Chinese Music held in New York in 1988. It’s the first time since 1949 that distinguished composers from Mainland China and Taiwan, separated by the sea, each had ten representatives who sat down together at Columbia University to have artistic discussions and a cultural exchange. They found so much in common in tradition and creation! The other was the Pacific Composers’ Conference, part of the Pacific Music Festival held in Sapporo, Japan in 1990, which gathered established composers and dozens of excellent young composers from many countries and areas in the Pacific Rim. Their ages ranged from early 20s to late 70s. The festival included concerts, seminars, lectures, and exhibitions for cultural exchange. He enthusiastically supported many young artists around the world.

When I first came to the States, the Central Philharmonic Orchestra from China premiered my Duo Ye No. 2 at Lincoln Center in 1987, but Prof. Chou had to attend another concert with his own work premiered in New Jersey. Nevertheless, he arranged for a huge bunch of beautiful flowers made by his wife Yi-An to be given to me on stage!  He also invited us to enjoy Thanksgiving holiday and learn American culture in his country house. Years later, when he visited UMKC Conservatory where we teach, he brought me a meaningful and beautiful gift: a fancy, richly illustrated volume (12” x 10”, 4 lbs), The Path of Beauty: A Study of Chinese Aesthetics by Li Zehou, translated by Gong Lizeng, and published in Beijing by Morning Glory Publishers in 1988. He said, “I think that you would love it and need it especially for your teaching in English.” I was deeply touched when he handed the book to me. Prof. Chou Wen-chung was truly a wenren (artist-scholar, Renaissance Man). He was a great creative artist and mentor who combined literature, music, and art, all in one. He wanted to be a person who gave as much as possible to the whole world. He is my role model and has encouraged me to keep working harder in music creation and teaching for our society.

Professor Chou Wen-chung was among the first overseas composers to visit the Central Conservatory in Beijing and it made a deep impression on a group of young composers there.

In the late 1970s, Professor Chou Wen-chung was among the first overseas composers to visit the Central Conservatory in Beijing and it made a deep impression on a group of young composers there. His music immediately attracted me, such as his Yu Ko and other orchestral works. His aesthetic concept is based on the philosophy of the intellectuals from older times who played the qin, and on the ancient poetry of China. I composed Song of the Ch’in for string quartet and Su for flute and qin (ch’in) before I came to study overseas, both of which were very strongly influenced by Prof. Chou’s introduction of Chinese scholarly music to us.

After graduation from the Central Conservatory in 1983, I was assigned as the Composer-in-Residence for the China National Broadcasting Corporation. In 1985, I became the first composition student from Beijing admitted to Columbia University in New York City to study with Prof. Chou through the introduction of Mr. Li Ling, a family friend who was the vice president of the Chinese Musicians Association. On one of Prof. Chou’s visits to China, Mr. Li passed along some of my compositions including my first recordings of my orchestral works and Chinese instrumental compositions along with a broadcasting concert recording to Prof. Chou, who took them back to the composition admission committee at Columbia. There, the professors on the committee included Prof. Chou as the head, along with Profs. Mario Davidovsky, and Jack Beeson. They reviewed my scores and awarded me a full scholarship.

While I took some courses and composition lessons with Prof. Chou, he realized that I was very lonely, and he wanted to help bring my wife Chen Yi to study at Columbia University with me. He knew that she was an excellent student.

I had a cultural shock when I first arrived New York, and I encountered many ideas that were new to me. For two years, from 1985 until 1987, I didn’t compose anything. While I took some courses and composition lessons with Prof. Chou, he realized that I was very lonely, and he wanted to help bring my wife Chen Yi to study at Columbia University with me. He knew that she was an excellent student of Prof. Wu Zuqiang, who was the president of the Central Conservatory of Music in Beijing, and a close friend of Prof. Chou’s, who helped leading the US-China arts exchange activities in China. Chen Yi arrived in New York in 1986. Prof. Chou then guided me to learn not only from traditional Chinese music, but also to explore wider traditions such as East Asian cultures, including music from Japan and Korea. He also gave me concert tickets to attend the opera Einstein on the Beach and the Netherland’s ballet with Bolero during the first two years of my study in the US. He encouraged me to study with his colleagues, Professors George Edwards and Mario Davidovsky. In 1987, I started to compose again, with Wu Ji for piano and electronic sound, and a mixed quintet, Dhyana for flute, clarinet, violin, cello, and piano. The score of Dhyana is dedicated to Prof. Chou since he gave me so much inspiration and input when I composed the piece, from the concept and the philosophy, to textures and structures. After eight years at Columbia, I received my Doctoral of Musical Arts degree in 1993. When I was awarded a Pulitzer Prize for my first opera Madame White Snake in 2011, Prof. Chou called me on the phone to congratulate me warmly. I feel deeply grateful for his mentorship and support.

I think the most important aspect of my work with Prof. Chou involved his theories of composition and creation. Prof. Chou’s educational philosophy is culturally oriented. Today people can accept a wider range of styles, but that’s not the issue. You must believe in your artistic vision, then your compositions can stand out. Prof. Chou Wen-chung’s vision and effort established the international status of our generation of Chinese composers.

Myra Melford: Freedom and Form

Like so many of today’s most exciting music creators, Myra Melford is not easy to categorize, although she is “happy” being described as a jazz musician, and that is how most of her music has been characterized and marketed for decades.

“Jazz is an inclusive music,” she exclaimed when she visited us at the New Music USA office in September. In recent years, however, she has also been creating compositions for so-called contemporary classical ensembles such as the San Francisco Contemporary Music Players.

“I understand that a lot of what I do works in the jazz context,” Melford elaborated. “Not all of it, but I identify as a composer-performer-improviser, which includes jazz, but isn’t limited to jazz in terms of improvisational music. And the longer I’ve been teaching in the composition program at the University of California at Berkeley, the more I feel comfortable in the new music community.”

She is less comfortable when she is labeled “avant-garde,” despite the cutting edge nature of so much of her work since the term has become saddled with tons of preconceptions that limit the music. As she explained, “When I get together with my students early on in the semester, it’s interesting to me that they conflate free jazz and avant-garde and that playing free jazz today will sound like it did 50 or 60 years ago. That’s what I think the problem is. Avant-garde to me has always meant someone in the advance of where the music is going, so it seems to me that there’s a problem if we don’t agree on what the term means.”

Melford is equally comfortable performing an Otis Spann blues tune with Marty Ehrlich, jamming in a completely free-improvisatory trio with Zeena Parkins and Miya Masaoka, or exploring more predetermined structures in the compositions she creates for her own ensembles, though most of the time these are also left somewhat open for there to be room for improvisation and individual interpretation.

“I don’t have a formal idea about what’s going to happen in any given order,” she admits. “It’s more like: I like this bit of material and that bit of material and that bit of material; let’s see, do they naturally flow together if I switch them around? Then usually I’ll have a pretty worked out draft of that material to take to a rehearsal and then I may make changes after the rehearsal. … If I have a very strong idea of what I want, then of course, I’ll put that forward, but if I’m still questioning how to do this or what would be an interesting way to approach this, I love getting input from the people I’m working with … I think what really makes it work is that the vocabularies of the people who play my music are so vast and can reference so many different things and are the kind of people who are adventurous and would get bored playing the same way all the time.”

Call it an “organic approach to composition,” which is how her one-time teacher Henry Threadgill described his process during their studies. Melford’s approach curiously also comes, albeit somewhat intuitively, from growing up in a house designed by Frank Lloyd Wright.

“I had been studying the architecture of Frank Lloyd Wright since I was a high school student,” she remembered. “He had also referred to his own process of developing a building or an architectural project as organic, wanting the building to look as if it had grown out of the environment, blurring the distinctions between what was outside the building and what was inside the building. For instance, having paving stones inside the building that extended outside the building. Or the way he used windows and an open floor plan where one room flows into the next. These kinds of things really dovetailed with what Henry was talking about. You start with a cell and you create these permutations. Instead of forcing a form on it, or predetermining the form, you let the form grow naturally out of how the musical materials expand. So, for sure, that also contributed to this aesthetic that I was going to blur the boundaries between what was improvised and what was composed and would be looking for ways of creating form that allowed for a lot of freedom.”

Sealing the Deal: Signing the Contract and Completing the Collaboration

The previous articles in this series discussed how to find a writer to collaborate with, what to consider when deciding to work together, and the permissions and compensation that form the core of a text-setting agreement.

Assuming you are setting a completed text in a transactional partnership, you’re now ready to write up your contract, get it signed, and start composing. If the author is creating new text or your partnership is highly collaborative, you may want to discuss one final item to include in your written agreement: what happens if something goes awry?

When new text is involved, the most important question is how to handle a complication in the delivery of the words. Though unlikely, it is possible that illness, incapacity, or other circumstances might delay your partner or even prevent them from writing the text. Should they be delayed, you could agree to an extended deadline and amend the contract accordingly. However, if an extended deadline is not possible within the constraints of the given project or if the author cannot complete the text even with an extension, you need a plan for how to dissolve the partnership.

Just as music commissioning contracts typically have a failure to deliver clause, agreements involving the creation of new text should have a similar stipulation. Essentially, such a clause states that if a person doesn’t provide the contracted materials by the agreed deadline and no extension has been granted, they will return any compensation they have received to date and release the other party from their contractual obligations. This creates a clear path forward in the unfortunate event that the author cannot finish the promised text.

Similarly, you should discuss what would happen if the composer is unable to complete the music as planned. While this doesn’t impact an author the way a problem in text delivery affects a composer, it does have implications for the life and profitability of the author’s work.

If the composer is given non-exclusive permission to set the text, the author/publisher is able to license other settings at any time—so one composer’s inability to complete their setting doesn’t render the words unusable. However, in cases with exclusive permission, failure to deliver the promised composition could mean those words might never be used in a musical work. To avoid that possibility, your contract should outline the circumstances—for example death, incapacity, or extreme delay—in which the author is free to license the text to another composer. You should also discuss whether those circumstances necessarily will entail a revocation of all granted permissions or simply convert the composer’s license to a non-exclusive one.

Failure to deliver the planned composition also has financial implications. If the agreement includes payment of upfront fee, the author/publisher would be compensated for their work regardless of whether the composer ever writes the music. When compensation comes as a share in future sales/rentals and/or performance royalties, the author/publisher would miss out on any income from the composer’s planned use of the text. So it is important to think about these possibilities when negotiating compensation.

A final contingency to consider applies to projects involving high levels of interdependency: how will you deal with communication delays or disagreements? Discuss what each person might do if the other is late in sending feedback or in responding to questions. Also figure out what you will do if you and your partner disagree about some aspect of each other’s work or about the project as a whole. It is best to decide up front who has the final say about the words, story (for dramatic works), music, or other aspects of the project should you be unable to reach an agreement about something.

Drafting the Contract

With any necessary contingencies discussed, you and your partner are now ready to formalize your agreement in writing. While an author/publisher may have a standard contract they use, I recommend composers have their own template ready. Even if you don’t end up using it for a given collaboration, it can be a handy reminder of points you may need to negotiate when using someone else’s template.

If you’ve never worked with a writer before and aren’t sure what to include in a template, you can use the sample text-setting and collaboration agreements I’ve put together as a starting point. (Disclaimer: I’m not a legal professional, and I encourage you to consult a lawyer to look over your contracts!)

At a minimum, your contract should include the following:

1.) Names/contact information for all parties
2.) Which text(s) the composer will be setting
3.) What permissions are granted
4.) What compensation is promised in exchange
5.) Signatures from all parties

If the text is already written and the partnership is more transactional, nothing else would be necessary. When the author will write new text, details about their planned work (subject, length, form, genre, etc.) and deadlines for delivery should also be included, as should contingency plans. For more collaborative partnerships, points related to working process, communication, how artistic decisions will be made, and similar considerations also may be listed in the written agreement.

Always consider the first version of a contract to be a draft. If using your contract, give your partner time to review the agreement and consult a legal professional as desired. If someone else sends you a contract, you should similarly read through everything carefully and seek advice as needed. Commonly, additional discussion will be needed to clear up any questions or concerns about the first—or second or third—iteration of the contract and to revise as needed.

Finalizing the contract may be completed quickly, or it could take weeks. Make sure to allow time for this part of the process. Once everyone is satisfied with the terms, the parties will sign, and the agreement will become binding. Any changes after that point must be agreed upon by all signees in writing.

Navigating the Collaboration

After having “The Talk” and formalizing your agreement in the contract, both parties should have clear, realistic expectations about their responsibilities and how the collaborative process will play out. The contingency plans you’ve put together should help if things don’t work out as anticipated, and with any luck, you will have a satisfying, successful collaboration.

It is natural to encounter minor annoyances, conflicts, and other difficulties when working closely with another person.

However, that doesn’t mean everything will necessarily be perfect. It is natural to encounter minor annoyances, conflicts, and other difficulties when working closely with another person. If—or more likely when—something bothers you during your partnership, weigh the benefits of bringing it up against the possible waves it could create. Like in other personal relationships, you’re better off not sweating the small stuff.

If you do decide something is worth discussing, bring your concern to your partner in a respectful, non-accusatory manner. Listen to their thoughts on the issue, and work together to resolve the conflict. Similarly, if your partner comes to you with something that bothers them, don’t become defensive. Take some time to think it over and try to see your partner’s point of view. Then discuss the situation calmly.

Always handle bumps along the road with professionalism and compassion—balanced with a reasonable amount of self-advocacy. Remember, you respect each other as artists and people, and you are both committed to the project. Handle any difficulties in a way that gives your work the best chance for successful completion. Any lingering issues can be addressed when considering whether or not to work together again.

Once the project is completed, you will need to manage certain on-going responsibilities. Where possible, you should notify authors of performances of the piece and share relevant materials such as recordings, promotional posts/articles, reviews, etc. You should also work with presenters to ensure the writer is acknowledged in publicity materials and concert programs.  Additionally, you should make sure that any performances are being reported to your PRO and credited appropriately, so that the author can receive their share of any royalties. Finally, if you agreed to share a percentage of music sales/rentals, you need to distribute those funds as outlined in the contract.

I recommend taking time to reflect on the collaboration once it is done.

Beyond keeping up with those duties, I recommend taking time to reflect on the collaboration once it is done. Each experience can reveal important insights about what to seek and what to avoid in future partnerships. You can get a better sense of who you are compatible with, what you want in an artistic alliance, what makes you uncomfortable, and what your deal-breakers are—all of which can help you be more aware and better prepared for successful collaborations in the future. You may even want to have a post-mortem discussion with your collaborator, so that you can benefit from their insights into the working process.

When reflecting (alone or with your partner), think about what you did and how you felt throughout the project, as well as how compatible you were with your partner. Consider questions like: What went really well and why? What can you do to help that happen again in future partnerships? What could have gone better and why? Is there anything you can do differently in “The Talk” or any changes you should make in your contract to improve your next experience? Approach these questions constructively, rather than looking to assign blame for anything that might not have turned out the way you wanted.

Based on your reflection and/or post-mortem discussion, you may decide you’d like to work with your collaborator again or that you want to try working with someone new—or both, since composer-author partnerships don’t need to be monogamous. You might tweak your contract template or note additional issues to bring up the next time you have “The Talk” with someone. You also may identify signs that you would or would not work well with someone, and be able to watch out for those when interacting with possible partners.

Collaborating is a lot like dating: you won’t want a serious relationship with everyone you meet, but there are compatible partners out there. The more you work with writers, the better you will get at finding those you will be compatible with and setting yourselves up for a mutually satisfying experience. Though it may take several attempts, you will find one or more people that turn out to be your soulmates. And finding those people is rewarding enough artistically, professionally, and socially to make trying and trying again worthwhile.

Pursuing the Ir Rational

Since then, he has continued to create and perform music in the same seemingly infinite range of styles at the same staggering pace. Later this week, he will appear with the band Fourth Blood Moon in Lugano, Switzerland (Oct 25), Turin, Italy (Oct 26), Venice (Oct 27) and Vienna (Oct 28). Then it’s on to duo and solo appearances in Bologna (Oct 30) and Milan (Oct 31) followed by a tour of Japan where he will perform solo, with a big band, and in a duo with Carl Stone in Tokyo (Nov 19-22) as well as in duos with Yasuhiro Usui in Chiba (Nov 23) and Jim O’Rourke in Kofu (Nov 24). Recorded music has been sorely devalued of late but now I find the concert experience to be charged up, hotter than ever.

The process continues, asymptotic. The channels of my activities seem to be more clearly defined than ever before but by design they must allow for quick change, parallel realities, translation of state. They strive to balance the conceptual and the concrete, the abstract and the material, the direct narrative and the nonlinear, art and survival. Recorded music has been sorely devalued of late but now I find the concert experience to be charged up, hotter than ever. “IrRational Music” is still the best way to describe what I do in all of these channels. I can’t separate its pursuit from my desire not just to make art, but to understand how and why I do what I do and thereby find newer and deeper ways to do it. As my understanding of the Inner Ear grows, I ask if it can be separated from the Mind itself.

We believe that our minds define our selves, not just in the everchanging present, but delving back into our complete past and projecting forward into our still-incomplete future. Minds transmit and receive data in a feedback loop, constantly updating our state of being and inputting new information into our perceptual systems, a process essential to our survival (and perhaps the source of our consciousness). The search for the nature of this Mind of ours has been a puzzle and inspiration for both reflection and generation, extending back to the dawn of self-awareness. A signal is sent out, then received again at its source, but with the ever-so-tiny delay caused by the gap in the synapse. The receptor recognizes the original signal, perhaps with some hormonal stamp. In this transaction, this recognition, awareness of self could form, then consciousness.

With daily discoveries stretching boundaries, our minds have become plastic, mutable in function, digesting and accepting new definitions and generalizations. We may find these elements contradictory; we may find them enlightening and clarifying. With every advance in knowledge of the physical and chemical workings of the brain, humans remain—in a paradox worthy of Zeno—woefully distant from complete knowledge of the nature of their own consciousness. Gödelian concepts apply as well to our self-awareness: with self-perception nested in self-perception, are we doomed to perpetuate self-deception? Can we break out of the frame and actually know Mind? As we verge on a time when Turing tests will be aced by AI toddlers, how will we recognize the Mind of the Other when we’re still not absolutely clear as to its nature in ourselves?

Our very anthropocentrism has limited our outlook.

We might say that our craniocentricism blinds us and deafens us. Certainly our very anthropocentrism has limited our outlook. Only in recent decades have modern Westerners (as opposed to their pre-Cartesian ancestors) graciously admitted that other creatures might indeed possess consciousness. The common belief has been that consciousness and memory reside in the brain, are solely a function of its chemistry. Are we so sure that Mind can be divorced from organs and muscles, from viscera, from our bubbling neurotransmitter stews that drift out into the very air around us? Witness the octopus! It might be said that every sight we see, every sound we make or hear, every move or shift, every pheromonal handshake, is part of the free-floating and expanding consensual reality that is Mind. Even though our hardware has been running for many thousands of years without a major update, our software is continually transforming to accomodate new modes of data transfer and processing, environments, definitions and frameworks.

It’s no longer a radical notion that our individual memories have been externalized in something very like a cloud. And if memories can be external to the person, then could Identity itself, the individual consciousness, also be externalized? Would a conscious entity with no physical locus conceive of itself in the same way as an embodied one? How would the perceptual systems function in a disembodied Mind? What are the possible input and output devices? What would the mechanism of internal feedback be? If a disembodied Mind is to interact with a physical world, then what would the interface feel like, both to that Mind and to anyone encountering it? What would music be to such an entity?

Both concepts and technologies of Artificial Intelligence have advanced in recent years to the point that interaction with AI’s is considered a normal part of daily life. But is the “I” in AI the same “I” that we think of as intelligence, the”I” that is truly a sense of self? Mechanical processes, even when happening millions of times per second, even with a heavy feedback component, are not the same as intelligence and certainly not the same as consciousness. Will a digital zero/one on/off mind feel the same, both internally and externally, as a slippery-slope chemical mind? Where is the all-important porosity that makes our intelligence what it is? Could it be embedded in a process of knowing and deciding that is based upon the continuous polling of tendencies, analogous to quantum states? Explicit expression, but with vast amounts of background processing contributing to the flux? A meat-machine hybrid brain (that concept so beloved of modern sci-fi)? I’m waiting for the day that an AI can experience synesthesia and express it. And what about AS, Artificial Stupidity—might that be closer to human consciousness? Will an AI ever compose music that rends your heart and soul, or is this reserved for those whose language can’t be boiled down to just two states? Is the transcendent mystery of art somehow linked to the roots of its generation?

There’s much in the air these days about how our local universe is undergoing a “singularity,” how humanity must prepare itself for massive transformations. I contend that we’ve already been deeply into the singularity for quite a few years. A singularity isn’t built in a flash or even a day! Whether this is seen as glorious or apocalyptic depends on the teller, and there are as many definitions of the nature of this singularity as there are tellers. The development of “self-awareness” in computers is often cited as a primary sign of this cusp-point. Contact with an alien civilization is another. How will humanity find a commonality of expression to communicate with an intelligence conceivably so different from our own that there is no recognition? Again, the question of interface and who controls it. What will the emergent power relationships be? In science fiction, the superior alien intelligence often adopts anthropic form and speaks English. Will a truly emergent AI condescend to speak to us as equals or might it demand true peer-to-peer contact and insist that humans rise to the occasion? Could music be the medium by which we measure cosmic intelligence and consciousness? Will music allow us to morph into fully realized beings able to meet an unfamiliar modality halfway? Can we learn to communicate, perhaps even sing songs using airborne molecular polymers, chains of regenerated RNA? Flashes of color? Qubit packets? Modulated sine waves? Will that achievement equal a willingness to let go of our traditional assumptions of mind grounded in physicality, of music grounded in sound? By abandoning these moorings, do we abandon the very core of our humanity? If that is indeed the case, then we might finally ask “Is this a good thing or a bad thing?” and have reasonable expectations of getting a clear answer. What You Get and What You Give: Permission and Compensation for Setting a Text

Once you’ve found a writer whose words you want to set and discussed some basic logistics and interpersonal concerns relating to your partnership, you’ll transition to discussing rights, permissions, and compensation.

For transactional partnerships involving pre-existing text, the author/publisher keeps the copyright of the words, but allows the composer to use them in their piece. The composer then owns the copyright for the resulting musical work, but not the copyright for the words. If the author is creating new text for the composer to set, the same generally will be true.

However, if a composer and writer are co-creating the words and music (for example, in musical theater or a similar song-writing situation), then they might equally share the rights to both words and music. Contracts for that type of arrangement differ significantly enough from general text-setting agreements that they are outside the scope of this article.

Text-Setting Permissions

The heart of a text-setting agreement—whether for an already written text or a new one—includes the permissions granted to the composer and what compensation they provide in exchange. When the copyright holder of a written work grants a composer text-setting permission, they are licensing the text to the composer for specific uses. How exactly the composer can use the text and what they can thus do with their composition depends on the permissions granted.

There are six permissions a composer should get.

3.) to publish and sell the resulting composition

4.) to have the resulting composition recorded (audio and video) and to permit the commercial release, synchronization, and/or other transmission of such recordings

5.) to print the text with proper credits in concert programs and liner notes for recordings

6.) to create arrangements or similar derivative works of the resulting composition

Permission 1 allows you to incorporate the author’s words into a musical setting. Everything else depends on this license being granted.

Permission 1 may or may not be exclusive, and exclusivity may be given in perpetuity or for a specific amount of time. If possible, I prefer to get exclusivity for at least a few years for art songs or choral works, and in perpetuity for dramatic works. If I receive exclusivity for a fixed term, I make sure the agreement specifies that I will continue to have non-exclusive permission after exclusivity expires.

When giving text-setting permission, some authors/publishers may stipulate how the text can be set. Most commonly, they could prohibit the composer from changing the text. Others may allow repeating lines or words but forbid other alterations. Or, they might indicate that any proposed modifications must be approved by the author/publisher. Less commonly, an author/publisher may also give guidelines about the music itself. I personally have not encountered this issue, but it does happen. Still, unless an author/publisher insists on it, specifying details about the musical composition in the text-setting agreement should be avoided.

In any case, if the author/publisher includes a stipulation that is a deal-breaker for you, try to negotiate with them. If that doesn’t work, you’ll need to decide if you can live with that arrangement or if you should walk away.

Permissions 2-4 ensure your composition will have a long, productive life. More performances means more performance royalties, more music sales/rentals, and more possibility for future career growth. Recordings are vital for the same reason. Even if they are not directly generating income, recordings can help to attract potential performers, presenters, and commissioners. And if you do release a recording commercially or license it for use in film or on television, you and the author/publisher will receive added income. Allowing performances, recordings, and publication thus benefits all parties.

Permissions 1-4 are essential. Do not set a text without them.

There is a little more flexibility with the other two permissions. No. 5 accounts for the standard practice of printing texts to aid in listening, but should a copyright holder balk, it is not absolutely necessary. If you don’t get this permission, include a note in your score directing presenters to request permission to print the text in a concert program from the copyright holder.

Permission 6 is also not strictly necessary (and one could argue it falls under Permission 1). Still, I prefer to be explicit about the possibility of making arrangements or other versions of a piece up front. Generally, the splits for performance royalties, sales/rentals, etc. would remain the same for any such arrangements. The main exception would be any purely instrumental pieces based on a vocal work: there, the text’s copyright holder would not have any rights to royalties or other compensation.

Performance Royalties

In return for the permissions listed above, the composer would typically compensate the copyright holder in some way. First, in any piece where text is spoken or sung, the author(s) are entitled to a portion of the performance royalties, regardless of any other compensation they might receive.

Typically, performance royalties are split 50-50 between the publisher and all creators. The 50% creator share is most commonly divided 25% to the composer(s) and 25% shared by any authors not in the Public Domain. A 2/3-1/3 split or other arrangement is possible if all parties agree. (Translators—if applicable—are included in “authors,” as they contribute to the creation of the text. Remember, translations of texts that are Public Domain in their original language may not be Public Domain themselves. In such cases, you’d need to get permission from the translator/their publisher and compensate them for use of the text.)

The 50% creator share is most commonly divided 25% to the composer(s) and 25% shared by any authors not in the Public Domain.

For non-dramatic works, these royalties are collected by performing rights organizations (or PROs) like ASCAP or BMI, who distribute the funds to their members.  Authors must belong to a PRO to receive this income, so I suggest including a clause in the contract that the author must be a member of an appropriate PRO to receive their performance royalties.

Dramatic works like operas fall under grand rights, and such performances are licensed by the copyright holder(s). In that case, the composer or their publisher if they have one will need to distribute any licensing fees to the author(s). The split between composer, author(s), and if applicable, publisher should be specified in the contract.

Additional Compensation

There is no one standard for compensating a copyright holder to use a text. Some common arrangements are:

  • the author receives performance royalties but no additional compensation
  • the composer pays the author an upfront fee
  • the composer agrees to give the author/publisher a percentage of sales/rentals
  • the composer pays both an upfront fee and a percentage of sales/rentals

It is more likely performance royalties will be the sole form of compensation when one or more of the following are true:

  • the composer and author have a personal relationship
  • one or both is a student or emerging artist
  • the composer is receiving little or no money for writing the piece
  • the music will be self-published
  • the text is already written
  • financial need or other similar extenuating circumstances exist

Performance royalties usually provide more income over time than either an upfront fee or a percentage of the sales/rental income, so this arrangement is not an unreasonable possibility. Still, it is good to offer additional compensation when you can, especially if the author is writing a new text for your collaboration.

An upfront fee has the benefit of being a clearly defined one-time commitment. However, it requires an initial investment on a piece for which you may not have received any money yet. This can be problematic depending on your financial situation and the fee involved.

The amount requested can vary widely depending on who the author is, who the publisher is (if applicable), and who you are. If you are receiving a commission to write the piece for which you need text, you could offer a percentage of your commission fee. . If you are not being commissioned, you may have to pay the fee out of pocket. It could be relatively affordable, perhaps in the $50-200 range. Or, the fee could be a prohibitively high amount (up to $1000 or more) that you are unlikely to ever make back in future sales.

If the fee is beyond what you can afford, you might share details like planned list price, anticipated sales, or profit of similar pieces you’ve created in order to give the person with whom you are negotiating a more realistic sense of the finances involved. When the amount comes from the publisher, the author might be able to convince them to agree to a more reasonable fee. Or, if you have a publisher, they could negotiate with the author’s publisher on your behalf. Ultimately, though, if the fee is too high, you may need to find a different text or author to work with.

A percentage of the sales/rentals for the composition is another option. While this has the benefit of requiring no money up front, it could cost you more in the long-term if the piece is very successful. For published musical compositions, the publisher typically keeps 90% of the sale price. The creator share is 10%, which is split between the composer and author(s). That may be divided so that half goes to the composer and the other half is shared by any authors, or it may be split 2/3 to the composer and 1/3 to the authors. For self-published works, giving the author 10-15% of the sale/rental price is reasonable. Some composers may go as high a 50% share on sale/rental income. That split only makes sense if it comes after expenses, since you alone will be covering those.

If you are self-published, this approach also requires extra accounting to ensure the income is collected and distributed appropriately. You might make annual payments or periodic ones triggered when the author/publisher’s portion reaches a certain threshold (for example, when the total reaches $25). Whatever arrangement you and the author/publisher agree to should be detailed in your written agreement, as should the actual percentage.

Paying both an upfront fee and a percentage of sales/rental income is not to the composer’s advantage. It has all the downsides listed above plus an increased overall financial commitment. Unless you really want that text and cannot negotiate another arrangement, avoid this possibility.

Regardless of which arrangement you and text’s copyright holder agree to, you will want to write up the granted permissions, any stipulations, and all financial details into your contract. The final article of this series will focus on formalizing your agreement and completing the collaboration.

Transactional and Collaborative Approaches to Working with Authors

Informed consent is essential for successfully collaborating with writers.  In my previous article, I introduced “The Talk,” a targeted discussion you and a writer should have before beginning a partnership. The Talk’s purpose is to ensure you both fully understand what is involved in the collaboration and how you will work together. It involves establishing compatibility, negotiating both interpersonal and logistical concerns, and arriving at the informed consent necessary for an effective partnership. However, what each person must be informed about and consent to depends in part on whether the partnership will be transactional or more collaborative. 

Purely Transactional Partnerships

A basic type of partnership between a composer and a writer is:

  • The composer finds an existing text and requests permission to use it.
  • The copyright holder agrees.
  • The composer writes the piece.

This is an example of a purely transactional partnership. These involve fewer total interactions, and those interactions are less artistically impactful. That means personal compatibility is less critical than in other types of partnerships. Transactional text-setting can thus be a good way to test the waters with someone you might like to work more closely with in the future. Or, this hands-off approach may be your preferred modus operandi.

For transactional partnerships, you can likely skip the interpersonal aspects of The Talk discussed below and start with getting permission from the copyright holder.[1] The writer usually owns the copyright for unpublished texts (unless, for example, they are under contract with a publisher for a forthcoming book). The situation is more complex for published texts. Depending on when the text was published, the type of publication, and what agreement the author made with the publisher, the copyright may reside with the author or the publisher.[2]

In any case, the best first step is to contact the author. They should know who can license your setting, and more importantly, you want their approval for your project. If a writer is invested in you setting their words, they can give you permission if they hold the copyright or can help you secure permission from their publisher.[3]

Start by sending the author a short, polite message introducing yourself and expressing your interest in their work. Ask if they might be open to you setting their text and if so, could you discuss licensing. If you don’t hear back, wait a couple weeks and follow up. If you don’t hear back again, you may choose to send a third and final message. If they never reply or you couldn’t find any contact information for them, you might try the publisher directly.

Once an author responds positively to your inquiry, you can discuss licensing with them/their publisher. The next article will cover what permissions you need and what you should offer in exchange, since those topics will be applicable regardless of whether your partnership is transactional or more co-creative. For now, we’ll turn to non-transactional partnerships and the interpersonal portion of The Talk.

Collaborative Partnerships

Collaboration exists on a continuum. Purely transactional partnerships like those described above exist at one extreme with integrated co-creation at the other and a variety of possibilities in between. The type of partnership you choose will depend on your preferences, those of your collaborator(s), and the nature of the project.

Beyond being purely transactional, some partnerships may involve low levels of creative interaction. For example, a composer may ask the writer questions about their intentions or get a sense of the text’s pacing, structure, and tone by hearing the author read their work. Increasing levels of collaboration might involve: the author and composer working together to determine which text(s) will be set or the order of texts in a cycle, the author making alterations to the text at the composer’s request, the composer bouncing ideas off the author, or the composer getting feedback from the author about in-progress music. These activities increase both the amount of interaction between the composer and author, and the impact of those interactions, since they will affect the resulting music to greater degrees.

Additionally, if both are willing, they can share input on one another’s work as it progresses. These deeper types of engagement move toward the far end of the collaboration spectrum—integrated co-creation—which involves the composer and author working extremely closely on both words and music.

Partnerships that are more collaborative will require a higher degree of compatibility between the composer and writer to be successful, as will those that are longer term or otherwise more intense. The compatibility between you and a potential partner thus can inform what type of partnership you try. Conversely, being clear on how much collaboration is required in a specific project can guide you in choosing the right author. Either way, compatibility is an important consideration if you want anything other than a purely transactional partnership.

Assessing Compatibility

A big part of The Talk is assessing your compatibility and talking through any roadblocks to collaborating effectively. The questions below can serve as a starting point. The answers to these will be very individual, so it is worth considering them on your own before talking to your potential collaborator. Think not only about your responses but also what you would be comfortable with in a partner. You may have hard limits on these questions or could find a range of possibilities acceptable.

  • What are your artistic goals/vision for the proposed collaboration?
  • Will you be continuing to explore techniques/themes/ideas found in your previous work?
  • Are you looking to go in a new direction for this project?
  • What interests you in your potential collaborator’s work?
  • Is there something you are hoping your partner will or will not do in this project?

Process

  • What is your working process?
  • How much interaction do you want with your partner?
  • What types of interactions do you prefer?
  • How much time do you need to complete your work?
  • How do you handle deadlines?
  • What would happen if the author decides to revise the text after the music is started or after it is finished?

Feedback

  • How much input do you want to give about your partner’s work?
  • How much input do you want to receive about your work?
  • How and when will feedback be offered?
  • How much are you or your partner obligated to incorporate each other’s suggestions?

Communication Style

  • What are your preferred media for communication?
  • How quickly will you need responses to any questions?
  • How quickly will you be able to respond to your partner?
  • If talking in person or via phone/video chat is preferred, does your schedule allow for that?
  • Do you have any communication pet peeves or quirks that may impact the collaboration?

Prior Experience

  • Have you worked with a writer before, or has the writer worked with a composer?
  • If so, how did that collaboration go?
  • What agreements did you have in place for your prior collaboration(s)?
  • What expectations do you have based on that prior experience?
  • What might you like to do the same as before?
  • What might you like to do differently?

Once you’ve thought through these topics—or others that are important to you—have a frank discussion with your potential collaborator. Focus on those issues that directly relate to your proposed project. You may be on the same page, or may find that some problem-solving or compromising is necessary to head off potential problems.

You don’t need to agree on everything in this portion of The Talk, but you both should be comfortable with your compatibility and your plans for how you will interact. You also absolutely need to agree on deadlines, permissions, compensation, and any other details that go in your contract. The rest of The Talk deals with these elements.

Setting deadlines is both an interpersonal and logistical issue. Unless you are using an existing text or are proposing an open-ended project, your schedule and approach to deadlines must be compatible with each other’s and with the requirements of the project.

Build cushions into your timeline, and be clear about what deadlines are not moveable.

Scheduling can be a deal-breaker especially if the author is creating new text, so check availability early in the process and then discuss specifics. If the project has a firm deadline, ensure due dates for any intermediary steps, such as finalizing the text, fit the writer’s schedule while allowing you enough time to complete the piece. Build cushions into your timeline, and be clear about what deadlines are not moveable. Also discuss whether text must be completed before the music or if there will be any overlap or simultaneous creation. If a certain project doesn’t work out because of timing but you are otherwise compatible, plan to work together in the future and find another text of your current project.

Assuming scheduling works out and you both feel compatible enough to collaborate, the next step is negotiating permissions and compensation. These are important topics that are often not clearly understood, so they will be the focus of the third article.

A Primer on Collaborating with Authors

Introduction

I could wax poetic about why composers should set texts by living authors. Some big reasons include texts that stand out amid the sea of well-worn Public Domain poems, topics and style relevant to today’s audiences, more diverse voices and viewpoints, the ability to interact with the author, the possibility of tailor-made texts, and supporting another art form as a living tradition. I’d happily go on in detail about each of these, but I’d rather focus on actionable information you can use to start (or improve) your journey setting contemporary texts. So I will skip the justifications and assume you like working with words and are at least cautiously interested in setting text by a breathing human being.

While it is possible to find interviews where composers talk about specific projects working with authors, there is fairly limited information out there about the nuts and bolts of how to actually start doing it. Dale Trumbore has written about why and how to collaborate with writers in No More Zombie Poets, Part 1: Choosing Better Public Domain Texts and Part 2: Finding Writers Who Aren’t Dead. Aside from that, Stephen Paulus’s Before You Set Those Words to Music includes a clear introduction to copyright, Public Domain, and text-setting permissions. ASCAP and BMI each have some posts about such permissions as well.

My articles will draw on those sources along with my own experiences to explore the process of working with living authors. By authors, I mean writers, poets, librettists, playwrights, or any other creators of words. I’ll cover critical logistics such as finding collaborators, assessing compatibility, creating a text-setting agreement, and navigating the remainder of the process. My purpose is to provide a primer for composers who haven’t yet worked with living authors and to offer another veteran’s perspective to those experienced in collaborating with writers.

Finding Authors

A common question about working with authors is where to find them. If you want to set contemporary text but don’t have a specific author or work in mind, the prospect of finding someone whose writings you like, with whom you are compatible enough to have a good working relationship, and who is also interested in collaborating with you can appear daunting.

Rather, think of finding authors as a lifestyle and incorporate some or all of the suggestions below into your normal activities. Eventually, you’ll discover authors whose work interests you and start building relationships with them.

You could find contemporary texts and authors by browsing manuscripts at your local bookstore and perusing literary journals or similar periodicals. If you don’t want to leave the comfort of your couch, the American Academy of Poets’ website is a great resource. It allows you to search for poems, poets, keywords, poetry activities in your area, and more. They also offer a poem-a-day email subscription and frequently share poetry on social media.

Facebook, Twitter, and other social platforms are wonderful for connecting with potential collaborators. You may already have writers in your immediate network. Or, you could ask friends or colleagues for suggestions of writers to check out. Finding the social media account of an author you respect and seeing who they follow or whose work they share could also introduce you to new possibilities.

Additionally, some platforms include groups where you could find possible collaborators. I’ve found the following Facebook groups very helpful:

Searching for keywords like writer, author, poet, playwright, or librettist bring up many other groups that you might want to check out.

Meeting Authors

Discovering writers in person limits you to those in or at least coming through your area, but it also allows for more personal contact.

Your local bookstores or libraries may have upcoming readings by local authors or those touring a book. Area colleges may have Creative Writing programs that sponsor events, or you may be able to contact faculty to seek possible collaborators.

A Google search for events near you may also be fruitful. When I searched “Connecticut poet,” I found there is a Connecticut Poetry Society. Their website had information on readings and other events, links to local poetry groups and independent bookstores, an annual publication they sponsor, and more. There is a network called the National Federation of State Poetry Societies, which lists other state societies. Yours may have one, too, and there may be a city or regional group nearby where you can meet authors. If you travel, you can also look for events in your destination.

The programs listed here are primarily educational. Some are tuition-based, while others may be free or include financial support. Some are highly competitive, others less so. All provide the opportunity to meet and work with authors from a variety of locations on new projects.

Artist residences are another place you might meet writers if you can participate in one or attend their open studio days or similar events. As with the educational programs above, you are more likely to meet authors outside your local area at an artist residency.

Now What?

It may seem obvious, but once you’ve found someone you think you might want to work with, the next step is getting to know them. Get very familiar with their work and try to connect with them either online or in person. Start thinking about whether you might want to collaborate with them and in what capacity.

If you don’t have a pressing need to collaborate with them on an upcoming project, this process can happen naturally through building a friendship. Then you can bring up the possibility of collaborating once you have a project that feels right.

If you already have a specific project in mind—for example, you think something they wrote would be perfect for an upcoming piece—then skip ahead to proposing… a collaboration, that is. Express your interest in setting their text and describe the potential project to see if they might want to work together. If that writer is not familiar with your music, provide a small number of samples similar to the proposed collaboration.

Informed Consent and “The Talk”

Regardless of whether you find a willing partner through an extended courtship or a direct proposal, the next step is to have “The Talk.”

Regardless of whether you find a willing partner through an extended courtship or a direct proposal, the next step is to have “The Talk.” This is the phase in which you’ll discuss artistic goals, working process, and the logistics of your partnership including permissions for using the text, your financial arrangements, and any other necessary details. It’s akin to taking a big step forward in a romantic relationship, hence the capital letters.

And as with personal relationships, informed consent is the foundation for a successful artistic collaboration. Both parties must understand how the collaboration is going to work and agree in writing before starting the project.

Arriving at informed consent depends on self-awareness and clear communication. Each person should know their preferences in working with others, their creative process, and their artistic goals or intentions. They must also be able to articulate those elements to their partner, understand how their needs relate to those of their partner and the project, and negotiate any conflicts.

Some of that may happen informally as you and your partner are getting to know one another. Other items will need a focused discussion, either oral or written. Discussions in person, on the phone, or via video conferencing have the benefit of real-time responses and a clearer perception of tone. Both of which reduce the chance of miscommunication. However, this may be uncomfortable for some people.

Typed discussions have the advantage of ensuring that everything is written down and easily referenced. Email and other asynchronous methods may also be easier for scheduling. But the participants should be especially conscious both of their own wording and how they are reading the other person’s responses since typed communication can come off colder and harsher than intended. I typically use oral discussions for big issues and email to finalize details or give straightforward updates.

Regardless of how you do it, having The Talk is essential in setting the collaboration up for success. It will be the foundation for your written contract and a roadmap for navigating your partnership. These discussions also help you to get further acquainted and make sure that you really want to work together before you commit.

Tyshawn Sorey: Music and Mindfulness

Tyshawn Sorey’s music emerges from a vast array of experiences, communities, storytelling, and a deep engagement in mentor-mentee relationships. When I listen to his recent works Pillars I, II, III, and Everything Changes, Nothing Changes, I hear imagined worlds and sonic environments that are anchored in numerous histories and traditions. The detailed timbral designs within his compositions amplify a spiritual and creative focus in the music, asking the listener to employ mindfulness, to breathe, and to engage with spontaneity.

Sorey’s creative practice is multifaceted. His musical journey began as a trombone player in New Jersey where he listened to everything from be-bop to hip-hop and country music. He is in regular demand as a new music composer, writing for ensembles such as the International Contemporary Ensemble and the JACK Quartet. As a drummer, Sorey is a fixture on the jazz scene and can be heard performing with artists such as Vijay Iyer, Kris Davis, Marilyn Crispell, and Jason Moran, in addition to leading his own ensembles. Sorey has also developed a unique voice as a pianist and has played piano with artists such as composer/trumpet player Wadada Leo Smith and mrudangam artist Rajna Swaminathan.

Throughout his rigorous career as a composer and performer, Sorey regularly teaches and mentors other artists to support the creation of their own work. This practice has led him to become an assistant professor of music and African American studies at Wesleyan University. It is here, in his new creative home on the Wesleyan campus, that Tyshawn Sorey and I sat down to discuss his history as an educator, his latest works, and his thoughts about the word “improvisation.”
